Acceptance of Terms

By downloading, installing, and using the MomentCine application, you agree to be bound by the terms and conditions of this User Agreement. This Agreement governs your use of all features and services provided by the App, and by using the App, you confirm that you have read, understood, and accepted all the terms herein. If you do not agree to any part of this Agreement, please do not download, install, or use the App.

There is no requirement for you to create an account or log in to use the App. You can access all features of the App immediately after installation, without providing any personal identity information, contact information, or other sensitive data. Additionally, the App does not impose any age restrictions on users—any individual who downloads and uses the App in compliance with this Agreement is welcome to use our services.

The App Does Not Collect Facial Data or Facial Identity Information: MomentCine is committed to protecting your privacy, and a core part of this commitment is that the App does not collect, store, process, or transmit any facial data, facial identity information, or biometric data related to your face. This means that when you import, capture, or generate images using the App—even if those images contain human faces—the App will never extract, record, or save any facial features, facial recognition data, or facial identity details. The App’s AI model only processes images for artistic styling purposes locally on your device, and no facial data is collected at any stage of your usage. We do not use any algorithms or tools to identify, analyze, or categorize facial features, and we never collect any information that could be used to recognize or identify an individual through their face. Your facial information remains entirely on your device, under your full control, and we have no access to it whatsoever.

Scope of Services

MomentCine is an AI image styling App that provides users with the ability to import photos from their device’s camera or photo library and generate artistic stylized results with a single tap. The App’s core services include:

• Importing photos from your device’s camera or photo library for styling;
• Using the App’s built-in AI model to process imported photos locally and generate artistic results;
• Organizing generated results in a local Records page for easy management;
• Allowing users to view, save, share, or delete generated results;
• Providing clear access to the App’s Privacy Policy and this User Agreement within the App;
• Requesting minimal permissions (camera and photo library access) solely to enable core features.

All services provided by the App are processed locally on your device. The App does not rely on external servers, cloud storage, or third-party services to provide its core functionality, ensuring that your data and content remain private and secure.

The App Does Not Collect Facial Data or Facial Identity Information: All services provided by the App are designed to avoid collecting any facial data. When you use the App to style photos containing faces, the AI styling process only modifies the image’s artistic appearance (such as color, filter, or texture) without extracting or recording any facial details. The App does not collect facial landmarks, facial recognition templates, or any other data related to facial identity. There are no features in the App that require or involve facial data collection, and the App’s services are provided without accessing or collecting any facial information from users. Your facial privacy is protected at all times while using the App’s services.

User Responsibilities

When using the App, you agree to assume the following responsibilities to ensure a positive and compliant user experience for yourself and others:

• You are responsible for ensuring that you have the right to use any photos you import into the App. This includes ensuring that you own the copyright to the photos, or that you have obtained the necessary permission from the copyright owner to use the photos with the App. You agree not to import any photos that you do not have the right to use.
• You agree not to use the App to generate, save, or share any content that is illegal, harmful, offensive, or infringing on the rights of others. This includes, but is not limited to, content that is violent, discriminatory, obscene, defamatory, or侵犯他人隐私 (other than facial privacy, which the App already protects).
• You are responsible for managing your device and the content stored on it. The App stores generated results locally on your device, and you are responsible for backing up your content if you wish to preserve it. The App is not liable for any loss of content due to device damage, loss, or accidental deletion by you.
• You agree to use the App in compliance with all applicable laws and regulations in your jurisdiction. You also agree not to use the App in any way that could damage, disable, overburden, or impair the App’s functionality.
• You agree not to modify, reverse engineer, decompile, or disassemble the App, or attempt to gain unauthorized access to the App’s source code, AI model, or internal features. Any unauthorized modification or access to the App is prohibited.

The App Does Not Collect Facial Data or Facial Identity Information: As a user, you do not need to worry about your facial data being collected or misused while using the App. You are not required to provide any facial information to use the App, and the App will never collect any facial data from the photos you import or the results you generate. Even if you choose to share generated results that contain faces, the App does not collect any facial information during the sharing process. Your responsibility to protect your own privacy is supported by the App’s strict policy of not collecting facial data, ensuring that your facial information remains private and secure.

Intellectual Property Rights

All intellectual property rights related to the App, including but not limited to the App’s source code, AI model, design, logo, name, interface, and any content provided by the App (excluding user-generated content), are owned by the developer of MomentCine (hereinafter referred to as the "Developer"). These intellectual property rights are protected by applicable copyright, trademark, and other intellectual property laws. You are granted a non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only. You may not copy, distribute, modify, sell, or otherwise exploit any part of the App without the prior written permission of the Developer.

With respect to user-generated content (including the original photos you import and the artistic results you generate using the App), you retain full ownership of all intellectual property rights to that content. The Developer does not claim any ownership rights to your user-generated content. You may use, save, share, or delete your user-generated content as you wish, subject to the terms of this Agreement and applicable laws.

The App Does Not Collect Facial Data or Facial Identity Information: The Developer does not collect any facial data or facial identity information from your user-generated content. Even if your user-generated content contains facial images, the Developer has no access to that content (as all data is processed locally on your device) and does not collect any facial details from it. The Developer’s intellectual property rights do not include any claim to your facial data, and the Developer will never use your facial information for any purpose. Your facial data remains your property, stored solely on your device.

Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied. The Developer does not warrant that the App will be error-free, uninterrupted, or free of bugs, or that it will meet your specific needs. The Developer does not warrant the accuracy, completeness, or reliability of any results generated by the App, as the artistic styling results are generated by an AI model and may vary based on the original photo.

The Developer is not liable for any damage to your device, loss of data, or other harm that may result from using the App. This includes, but is not limited to, damage caused by app crashes, compatibility issues with your device, or accidental deletion of content by you. You use the App at your own risk, and the Developer shall not be liable for any indirect, incidental, consequential, or special damages arising from your use of the App.

The App Does Not Collect Facial Data or Facial Identity Information: The Developer does not collect any facial data, so there is no risk of your facial data being lost, stolen, or misused by the Developer or any third party. The disclaimer of warranties does not apply to the App’s commitment to not collect facial data—this commitment is a core part of the App’s design and is strictly enforced. You can use the App with confidence knowing that your facial information will never be collected or accessed by the Developer.

Termination

This Agreement shall remain in effect for as long as you use the App. You may terminate this Agreement at any time by uninstalling the App from your device. Upon termination, you will no longer have access to the App’s features, but your user-generated content (stored locally on your device) will remain on your device unless you choose to delete it.

The Developer reserves the right to terminate this Agreement and your access to the App at any time, without prior notice, if you violate any of the terms of this Agreement. Upon termination by the Developer, you must uninstall the App and cease all use of the App’s services. The Developer shall not be liable to you for any damages resulting from termination of this Agreement.

The App Does Not Collect Facial Data or Facial Identity Information:Upon termination of this Agreement, whether by you or the Developer, the App will not retain any of your data—including facial data—because no data (including facial data) is collected or stored by the App in the first place. All your content remains on your device, and you can delete it at any time. Termination of the Agreement does not affect the privacy of your facial information, as the App never collected it.

Changes to This Agreement

The Developer reserves the right to modify or update this Agreement from time to time. Any changes to this Agreement will be posted within the App, and the updated Agreement will take effect immediately upon posting. By continuing to use the App after the changes are posted, you agree to be bound by the updated Agreement. If you do not agree to the updated Agreement, please uninstall the App and cease using the App’s services.

Any changes to this Agreement will not alter the App’s core commitment to not collect facial data or facial identity information. This commitment is fundamental to the App’s design and will remain unchanged unless required by applicable law (which does not currently mandate facial data collection).

The App Does Not Collect Facial Data or Facial Identity Information: Any updates to this Agreement will not include provisions that allow the App to collect facial data. The Developer’s commitment to not collecting facial data is a permanent part of the App’s privacy and user experience, and it will not be modified or removed in any future updates to this Agreement. You will be notified of any changes to the Agreement, but you can rest assured that the App’s policy of not collecting facial data will remain in place.

The Developer will respond to all emails within 2-3 business days and will work with you to resolve any issues or answer any questions you may have. When you contact us via email, we will only use the information you provide in your email to respond to your inquiry—we will not store your email address or any other personal information you share beyond what is necessary to address your request.

The App Does Not Collect Facial Data or Facial Identity Information: When you contact the Developer, we will never ask for or collect any facial data, facial identity information, or biometric data. Any information you share with us is used solely to respond to your inquiry and is not stored or used for any other purpose. We do not collect any facial information through our support channels, and your facial privacy remains protected even when you reach out to us for help.
